GENERAL
By commissioning me, the client agrees to the terms outlined in this agreement. These terms are binding and apply to all commissions, including any ongoing or future projects. I reserve the right to modify these terms.PAYMENTS
Prices: Prices for commissions are based on the complexity, size, and style of the artwork requested. The final price will be agreed upon before work begins.Payment Method: All payments must be made through VGen’s payment system or PayPal via invoice. Payments will be processed in USD (U.S. Dollars).Currency Conversion Fees: The commissioner is responsible for any currency conversion fees or additional charges that may arise due to payment processing.Payment: Full payment is required upfront before any progress begins.No Refunds: Once a commission has been paid and accepted, no refunds will be issued unless emergency circumstances call for it.REVISIONS
Sketch Phase: During the sketch phase, the client may request as many revisions as needed, as long as the revisions do not require completely redrawing the artwork. This includes changes to composition, details, and overall concept.Inked Phase: Once the artwork has reached the inked phase (final line art), no further revisions will be accepted unless there are minor mistakes that need correcting.Major Changes: Any changes that would require significant rework after the inked phase, such as altering the pose or major design elements, may not be accepted, or could incur additional fees, depending on the scope of the change.DEADLINES AND DELIVERY
Time Frame: Due to chronic illness, completion times for commissions can vary. For smaller projects, the estimated time of completion may be a few weeks, while larger projects could take up to 6 months. The exact timeline will be discussed with the client before work begins, but please understand that I cannot guarantee specific deadlines.Progress Updates: I will keep the client informed throughout the process, providing regular progress updates as I work. Communication will be maintained, and I will notify the client if any delays occur or if the timeline needs adjustment.No Set Deadlines: I do not accept set deadlines or rush orders due to my health condition. Please be aware that any timeline provided is an estimate, and the project may take longer depending on my personal circumstances.Delivery: Completed commissions will be delivered digitally via VGen in PNG format. Once delivered, the client is responsible for storing and backing up the files.USE
Personal Use: The commissioned artwork is for personal use only unless otherwise agreed upon. This includes usage for social media, profile pictures, and personal prints.Commercial Use: Commercial usage, such as selling prints or using the artwork in promotional materials, must be discussed and agreed upon separately and may incur additional fees.Credit: The client agrees to credit the artist when the artwork is shared or used publicly. Credit should be given in the following format: "Artwork by Astrograph-Magician."INTELLECTUAL PROPERTY RIGHTS
Ownership: I retain full copyright and intellectual property rights to the artwork, including the right to use it for self-promotion or portfolio purposes.Client Rights: Clients are granted a non-exclusive, non-transferable license to use the artwork according to the terms outlined above (e.g., for personal, non-commercial purposes).Reproduction: The client is not permitted to reproduce, distribute, or alter the artwork without explicit permission from the artist.REFUNDS
Refunds: No refunds will be issued once the commission has been started unless the artist is unable to complete the commission due to unforeseen circumstances (e.g., illness, personal emergencies).Cancellation: If the client wishes to cancel the commission before work begins, they will receive a full refund. If cancellation occurs after work has started, the refund will be partial based on the work completed.Chargebacks: Clients who initiate a chargeback on a completed commission will be banned from future commissions and legal action may be pursued if necessary.COMMUNICATION
Availability: I will make an effort to respond to inquiries and provide updates in a timely manner. Please allow at least one business day for replies.Platform: Communication should primarily be conducted through VGen messages or Discord.Progress Updates: Clients will receive progress updates throughout the commission process, including initial sketches and other key stages, to ensure the artwork is aligned with the client’s vision
